Advice about rent issue

Just got a call from the Landlord after his partner and I had a conversation about my rent being paid at the end of the month, or possibly earlier. His partner is not agreeing to that, and said if you don't have it by the end of Saturday then we will give you a five day eviction notice. He said and then we will toss you out on the street. He was a total jerk and said he didnt care what arrangement I had with the other guy, they are in business together but not quite partners and he's not going for it. He said the other guy is a lot nicer guy than I am. I have no problem saying no. Oh my, well if I get evicted, I get evicted, I have been a good tenant. It's hard to find a place that will rent to a person with two dogs. The apartments around here only want 25 lb and under. Broady is 70 lbs. I'll be sleeping in my car before I get separated from him. Of course I would not make my daughter do that, she would have to go to a friend of mines for a moment till I found something. I am not going to worry about this all weekend. but will work on finding somewhere for us to go. Goodness not a great way to start the weekend.

Wow what a jerk! I would say something worse but it'll just get censored. I can't believe they could serve a five day eviction notice. I could be wrong, but don't they have to give at least 30 days notice? Back when difficult child 1 was a baby her dad and I were having some big time financial struggles. We were late a lot, sometimes not paying a single dime for a whole month, and they didn't even consider evicting us because we were a young family and he knew we needed a place to stay. I guess we got lucky. I'm so sorry this guy is being an ass to you. Many hugs.

I saw his number come up on my phone and I thought maybe something was wrong at the apartment or that he just wanted to reiterate what we had spoken about yesterday. It was the other guy and when he started talking I asked him if he had the wrong person. I really thought he was confused and thought he was talking to another tenant or something. That's when I asked him if he had talked to his partner and he said we are in business together but he's not my partner. Oh my, I was as nice as I could be, and said if he is not supposed to call tenants and set up payment arrangements than maybe you should discuss that with your business associate. He said I have and now I am calling you and telling you the arrangements are a no go. He kept saying can you tell me 100% you will have it tomorrow. I said no, I am not going to lie to you, I will not have it till the end of the month as I stated yesterday. Ugh.

They're trying to scare you into coughing up the cash. It takes at 30 days after being served an eviction notice for you to be escorted out (if you don't leave voluntarily).

I would have thought he would have preferred to have his money at the end of the month than, have to find a new tenant and everything. I keep a clean house, I decorate and have a beautiful container garden outside, i have paid on time previously. I will have to use that money to find another place to live. I am researching illinois law on evictions. it says 5 day notice, then they file in court and then the court can give me anwhere from 7-14 days to be out of the house. It could take me a week to get a court date. If he does it and it's during my conference I won't know what to do. I have to go its mandatory for my job I have about 4 days ill be out of town between now and the 1st. ugh this just gets more complicated.

Jody, hon, don't make preps to move until you have that eviction notice in hand. And I know it's hard, but try not to let this kick your anxiety up into high gear.

They're messing with you trying to get you to hand money you don't have over to them. This is a method that works about 50 percent of the time with slackers. IF you should get that eviction notice in hand........don't pay them. I'm sure you made a deposit on the place, let them keep it.

This is a years lease? Never heard of landlords having a holy cow over a single month's late rent unless it was a month to month lease. Two, yes, one.....not really especially if they have the cash in hand when you say they will. Why? Because it IS a major PITA to try to get good tenants that pay on time. It's true that due to the economy it is somewhat a landlords market right now.......but I can't imagine that it's to such a degree that chucking someone over 1 month of late rent is worth the fuss.

Odds are, you'll give them the money when you said you would. Landlord will grumble something about Don't ever let it happen again or you're OUT......and that will be that.

If not? And they're going to be this huge of jerks over something like this in this economy where everyone is hurting??? Honey, you need to find somewhere else for your own peace of mind.

This is on a LEASE? What does the lease document say about late rent payments?
Normally, it's harder for a landlord to evict on a lease than month-to-month. We always did month-to-month for that reason.

Calm down and think about this logically for just a minute. Today is the 19th. You said you would pay on the 31st (and I'm going to assume you are paying last month's rent late, the late fees, plus November's rent - right?) That's a lot of cash.

The landlord / partner threatened to give you a five-day-notice if you do not pay by the 20th.

OK - follow me here...

You do not pay on the 20th (a Saturday). On Sunday the 21st, they are going to draw up a five-day-notice (really, on a Sunday? OK - let's say that they do...)

The five-day-notice will demand that you leave by the 26th. (Really? Just before you are going to give them all that money???)

If you do not leave by the 26th (a Friday) they are going to go to court on Monday (the 29th), pay the court fees and file a motion demanding that you leave the partment by October 13th.

Really??? Really??????

Personally, I think they are full of you-know-what because if they had thought this through at all....they would know it will cost them more to evict you than to wait for the money. This will probably turn out to be a whole lotta nothing.

That said, if they DO hand you a notice - save all that money you were going to pay them on the 31st and use it to move. You don't need to rent from people who would act that way.

Thanks, everything you all said makes sense. This man is an idiot. I made an agreement and I am keeping it, if I have to go to court i will tell the judge exactly what happened and I can prove that I normally pay on time. i am just not going to get anxious about this, came home got some hot tea, and lit a candle, getting ready for a garage sale tomorrow and make chicken and noodle soup tomorrow. Going to play with the dogs and hang out with difficult child, not worry about something so crazy. If I had it I would hand it right over. I can't imagine having the rent and just holding on to it. I am on a lease till April 1st 2013. This is my third year here and I've never been in trouble of any kind.

Hey, Jody. While it is still fresh in your mind and you can use this thread to verify...make a day to day list of who called you, what you said, whom you called and what you said and have that ready along with the payment record. THEN repeat the Serenity Prayer, my friend. It somehow helps to kee things in perspective. Hugs. DDD

Oh Jody, just wanted to send you tons of support. Money issues are so stressful. I've opted for negotiating with utility people because they have to take payments here. It sounds like they are just trying to strong arm you. I hope the garage sale goes well. Many hugs.

I was going to say just what Daisy said. If they want to spend their money sending a 5 day letter to quit, then they are fools because by the time they get the letter to you the money will be to them. It is wasted money. And with you on a years lease, they cant do a 5 days eviction. Im sure your lease says they have to give you 30. That is standard form on all leases. They certainly wouldnt allow you a 5 day notice to leave.
