I don't know the criteria to follow to assure you can legally assign one. The department you worked with to get the disability from may be able to help you in legally setting up the payee. </p><p> </p><p>Because he is an adult and biomom will most likely object to anyone blocking her from getting the money, you need to make the payee a legal one.
