    Fighting the school..

    I am so tired of fighting! I won't give up though!

    My daughter was dx'd with an LD - NOS. She has a lot of weak areas. Verbal Comprehensin Index was a 73. If I am not mistaken this would fall under the category of Auditory/Linguistic Processing, for the DOE's eligibility criteria. They however skipped right over it!

    She has been denied SPED services, and offered a 504! I as now, have not accepted it! I was told by educational specialists not affiliated with the school to advocate for SPED, and refuse the 504. So, I guess maybe I am doing the right thing?

    Has anyone went through this, having a child denied on an IEP in favor of a 504?

    You are right not to sign off on the 504. Did you directly question the team as why they skipped over the VCI? Was this an area of concern to you before testing? Would you be opposed, either financially or principally, to getting an outside evaluation?

    It's been a while since I've read the regulations, but the basic idea is that a child qualifies for an IEP if their diagnosed disability interferes with their ability to learn. I know that is a loose definition and there is a particular criteria for qualification, but that's the basic. Is your daughter having significant academic issues at school? Any behavior issues that may have caused the team to have "muddled thinking"?
