Texas Middle School Keeps Breaking IEP?

Ok so my son is in 6th grade and has been diagnosed with having aspergers and I use to have a 504 the first part of the year but now all the teachers and Principal and the Sped. Director were there when we all agreed on the IEP. The IEP states that he can go to a quite place when he is stressed or about to have a big rage. We take him every friday too a psychiatrist he has learned to hold it in till he gets to the safe place or quite place. Recently (21 times) has ask the teachers to go to the quite/ safe place which is in the office and they always say no sit down and do your work. I refuse to put him alone in a room with a couple of other students he is surprisingly very social =D! and i want to keep him that way at all possible, since most aspergers are not. I have told all the teachers, principal, and Sped. Director that the IEP States he can go to this room when he needes it not when it convienced them. They still dont want to follow the IEP. S can I sue?
