Even after raising his adopted son for 10 yrs now like just giving up on him. He is still bound by legal grounds and physical custody of him due to his ex wife's instability and irresponsibility as a parent.

This boy is adopted? and then had an unstable up-bringing?
Just my opinion, but... run for the exit. If the dad isn't prepared to step up to the plate and do what is needed, you have no power to do anything. And if this boy comes into your home, you are putting your younger child at serious risk.

Life wasn't supposed to be this hard. Or this complicated. But it is.
