Remember, even if a person under 16 consents to sexual intercourse, the state of Oklahoma deems that person legally unable to give consent. If a 19-year-old high school senior had "consensual" sex with his 15-year-old girlfriend, he would be guilty of second degree rape under Oklahoma law. The law also applies to same-sex relationships.</p><p>Oklahoma statutory rape is a strict liability offense. This means that, regardless of the intent, if a person over the age of 18 has sexual intercourse with a person under the age of 16, he or she is guilty of statutory rape. Whether the encounter was consensual and whether the couple were in a steady relationship are of no consequence. If the sex occurred, the statutory rape occurred.</p></blockquote><p></p>
